The plaintiff sought to recover a forfeiture of £500 on the ground that the defendant had not qualified himself as lieutenant in a foot-regiment by taking the oaths, but judgment was given for the defendant by eleven judges to one on the ground that the king can of himself dispense with any penal laws.
